The following terms and conditions relate to the provision of any services or sale of products (including physical products or downloadable material) from The Wellness Emporium – https://thewellnessemporium.com.au & The Wellness Emporium Programs – http://programs.thewellnessemporium.com.au (“Site”) (“Services”) (“Terms and Conditions”). These Terms and Conditions constitute an agreement between The Wellness Emporium ABN 75 704 502 781 (“The Wellness Emporium”, “us”, “we”, “our”), the owner and operator of the Site, and any Services and you (“you”, “your” or “user(s)”), a user of the Site and/or Services (“Agreement”).
By using our Site or any Services you agree to be bound by this Agreement, our Website Terms of Use and our Privacy Policy. Our Agreement, Website Terms of Use and Privacy Policy may change from time to time and will come into effect when the updated terms and conditions are posted to the Website. Your continued use of our website, social media platforms, online programs or services indicates that you have read, understood and agreed to the current version of the Agreement.
If you do not agree to the terms and conditions contained in this Agreement, Website Terms of Use or our Privacy Policy (or any subsequent amendments) you must cease using our Site and Services immediately.
Users must be 18 years or older to purchase any of our products or Services.
Health Disclaimer
The contents of The Wellness Emporium — whether through our websites, social media platforms including Facebook, Pinterest, YouTube and Instagram, or any other materials distributed by The Wellness Emporium — are for educational and informational purposes only and are not meant to replace advice or information provided by your personal healthcare provider.
Supplements and changes to diet can interfere with the absorption of certain medications and may be contraindicated in certain medical conditions. It is your responsibility to contact your primary healthcare provider if you are taking any prescription medication, pregnant, breastfeeding, have an existing medical condition, or suspect you may have a medical condition, before embarking on any programs, services or advice given by The Wellness Emporium.
Products issued and information provided through our website, services, programs and other platforms associated with The Wellness Emporium should not be used for diagnosing, treating, alleviating or relieving any medical or health conditions, nor to guarantee any particular outcome or results.

You are solely responsible for the proper and safe handling, preparation, storage, use and consumption of the products you receive from us. All products distributed by The Wellness Emporium are designed for adults 18 and older. You are also solely responsible for knowing about any food allergies you may have and for verifying the products and their ingredients before handling, preparing, using or consuming such products.
We do not claim to “cure” disease; we simply help you make physical and mental choices to support your body’s healing process.
We reserve the right to change any and all content and to modify, suspend or stop providing access to the Sites (or any features or functionality of the Sites) and the Products at any time without notice and without obligation or liability to you.
Through our websites and social media you may find links to other websites which are not under the control of The Wellness Emporium. We have no control over the nature, content or availability of those sites. Please contact those sites directly for any related issues.

Payment
We use a secure online payment system.
You will be required to provide your credit card or payment information in order to purchase any of our Services or products. Payment information may be shared with our third-party payment processors. By purchasing through our Site, you agree that we may charge you the price listed at the checkout screen, and that any payments made via credit card may attract an additional percentage fee as charged by the relevant merchant from time to time.
All orders must be pre-paid and will only be sent out or made available for download (for electronic products) after full payment of the total amount has been cleared.
You warrant that the payment details and any related personal details you provide are correct. We accept no liability in the event you fail to provide correct or complete payment or personal details, or for any losses suffered as a result of the fraudulent or unauthorised use of credit cards.
All prices are in Australian Dollars (AUD) unless otherwise stated, and are inclusive of GST in accordance with the A New Tax System (Goods and Services Tax) Act 1999.
From time to time we may issue promotional or discount codes. These can be redeemed at checkout and are subject to the terms of issue stated by us in relation to each promotion or discount.

All Services (including any goods) available from our Site are subject to consumer protections under the Australian Consumer Law.
Delivery & Shipping
If you are an Australian resident, you agree to pay any shipping and handling charges shown at the time you make a purchase. If you are outside of Australia, additional shipping charges may apply and will be charged separately after your order has been processed. Please email us at hello@thewellnessemporium.com.au before purchasing if you are located outside of Australia to receive a shipping quote.
Refunds & Returns
Our refund policy is in addition to your rights under the Australian Consumer Law as defined by Schedule 2 of the Competition and Consumer Act 2010 (Cth) (“Consumer Guarantees”). Nothing in this policy limits or excludes your statutory Consumer Guarantee rights.
We DO NOT offer refunds or returns due to the nature of our services and products, including but not limited to: pathology and functional testing, supplements, naturopathic and nutrition services, consultations, online programs and courses, eBooks and downloadable materials. We are limited by the legislation covering health and hygiene products and virtual product delivery.
Functional & Pathology Testing — No Refund After Purchase
When you purchase a pathology or functional testing package (including but not limited to blood testing, gut microbiome, SIBO, food allergy, or vaginal microbiome testing), the associated laboratory costs are paid to our third-party provider on your behalf at the time of purchase. This means:
- Your test kit is ordered and dispatched promptly upon payment being received.
- Refunds cannot be issued once a testing package has been purchased, regardless of whether the test kit has been used, the sample returned, or the associated consultation has been attended.
- If you choose not to proceed with the follow-up consultation after receiving your results, no refund will be issued for the testing package or any associated consultation fee.
- We strongly encourage you to consider your readiness to complete the full testing and consultation process prior to purchasing.
Practitioner & Appointment Time Preferences
Where the option is provided to indicate a preferred practitioner or appointment time at the time of purchase, please note that these are preferences only and cannot be guaranteed. Availability is determined at the time of scheduling. The Wellness Emporium will make every reasonable effort to accommodate your stated preference, however we do not guarantee any specific practitioner or appointment time. If your preferred practitioner or time is unavailable, we will offer suitable alternatives. Inability to accommodate a stated preference does not constitute grounds for a refund.
Full payment or deposits are required at the time of booking to secure your appointment. Payments are non-refundable; however, they may be transferred to another appointment if you need to reschedule outside of the cancellation period. Your credit will remain valid for 12 months from the original booking date, after which it will expire and cannot be redeemed.
In the event of any defect with our services or products, you must contact us immediately at hello@thewellnessemporium.com.au so our team can work with you to reach a suitable resolution. Defective products must be returned within fourteen (14) days of the original postage date to be eligible for replacement. Items will be replaced with the same item originally purchased.

To the extent permitted by law, our liability in respect of any breach of a Consumer Guarantee is limited, at our option, to one or more of the following:
- In the case of goods: replacement of the goods or supply of equivalent goods; repair of the goods; or payment of the cost of replacing or repairing the goods.
- In the case of services: re-supply of the services; or payment of the cost of having the services supplied again.
Where our jurisdiction does not permit limitation of liability, our total liability to you will not exceed AUD $100 or the total amount you have spent using our Site and Services within the last six months, whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless The Wellness Emporium and our parent, subsidiaries, affiliates, partners, officers, directors, employees, contractors, suppliers and agents from and against all losses, expenses, damages and costs, including reasonable legal fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your account.
